In a recent copyright infringement lawsuit, photographer Michael Kelley lost his case against Apple for briefly including his images in the documentary "Billie Eilish: The World's a Little Blurry". The images, referred to as "Airportraits" of a Maori cultural group performance, appeared for a fleeting seven to 14 seconds each, often obstructed, out of focus, or under low lighting, which led U.S. District Judge Gregory H. Woods to rule their inclusion as "de minimis" or minimal.
The ruling further emphasized that the photographs' background placement did not meet the standard for "intent" to disenfranchise Kelley from profiting from his work, labeling their use as "fair". The judge warned that a contrary ruling could potentially "stifle" creative works.
